1. Acceptance of Terms

By using AAQ, you acknowledge that you have read, understood, and agree to these Terms and Conditions, including the End User License Agreement (EULA). If you do not agree, please discontinue use of the platform and uninstall the AAQ app.

2. License to Use the Software (EULA)

a. Grant of License
Tantransha LLP grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the AAQ app on your device solely for personal, non-commercial purposes, in accordance with these terms.

b. Ownership of Software
The AAQ app, its design, code, and functionality, including all related intellectual property rights, are and will remain the exclusive property of Tantransha LLP.

c. Restrictions
You agree not to:

• Modify, copy, distribute, or create derivative works based on the app.
• Reverse-engineer, decompile, or disassemble the app or attempt to derive its source code.
• Use the app for any unlawful or unauthorized purposes.

3. User Accounts

To access AAQ features, you can create an account or participate anonymously for limited functionalities. You are responsible for maintaining the security of your account and all activity conducted under it. Unauthorized sharing or use of accounts is prohibited.

4. Use of the Platform

You may participate in broadcasts as a Broadcaster, Audience member, Moderator, or Platform Administrator. You agree not to use AAQ for unlawful, offensive, or harmful purposes and must comply with community standards and applicable laws.

5. User-Generated Content

a. Prohibited Content
Users are strictly prohibited from uploading, sharing, or broadcasting any content that:

• Is obscene, sexually explicit, or pornographic.
• Contains hate speech, violence, or threats.
• Promotes illegal activities or violates any law.
• Is discriminatory, defamatory, or offensive in nature.
• Violates the rights of others, including intellectual property rights.

b. Moderation and Reporting
Tantransha LLP reserves the right to review, moderate, and remove any user-generated content deemed to violate these terms or community standards. Users can report and block objectionable content directly through the app's reporting feature. User can also immediately end the session and objectionable content will not be visible to the user.

c. Consequences of Violation
Any violation of this clause may result in:

• Immediate removal of the offending content.
• Suspension or termination of your account.
• Reporting to appropriate authorities if required by law.

d. User Responsibility
You retain ownership of the content you upload, but by uploading content to AAQ, you grant Tantransha LLP a non-exclusive, royalty-free license to display, distribute, and share your content within the platform and on integrated services. You acknowledge that Tantransha LLP has the right to use your content in connection with the operation of the platform, including marketing and promotional activities.

e. Platform Status and Liability
Tantransha LLP operates as an intermediary platform that enables users to share and broadcast content. As an intermediary:

• Tantransha LLP does not directly create, modify, select or control user-generated content
• Tantransha LLP is not responsible for the accuracy, legality, or quality of content posted by users
• Tantransha LLP will respond to valid reports of prohibited content and take appropriate action
• Users are solely responsible for the content they create, share, or broadcast

6. Broadcast Content

a. Platform Status for Live Content
For live streams and live commerce:

• Tantransha LLP acts solely as an intermediary platform enabling users to broadcast content
• We do not pre-screen or monitor live content in real-time
• We rely on user reports and post-broadcast reviews to identify violations

7. Intellectual Property

All rights to the AAQ platform, app design, branding, and functionality are owned by Tantransha LLP. By uploading content to AAQ, you grant Tantransha LLP a non-exclusive license to display and share your content within the platform and on integrated services.

8. Privacy

Our Privacy Policy outlines how we collect, use, and protect your data. By using AAQ, you consent to the practices detailed in the Privacy Policy.

9. Third-Party Services

AAQ may include integrations with third-party services (e.g., social media). Tantransha LLP is not responsible for the functionality or compliance of these services.

10. Payments and Monetization

AAQ may offer paid features, such as virtual gifting or premium access. Users must comply with platform-specific monetization policies.

11. Refund Policy

Refunds for purchases made within AAQ, including virtual gifts, are not available. Refunds shall be applicable only if explicitly required by applicable laws or regulations, such as those mandated by Indian consumer protection laws.

12. Limitation of Liability

To the maximum extent permitted by law, Tantransha LLP is not liable for any direct, indirect, incidental, or consequential damages resulting from your use of AAQ, including loss of data or service interruptions.

13. Termination

Tantransha LLP reserves the right to suspend or terminate your account or access to the app if you breach these terms, especially violations of Section 5. Upon termination, your license to use the app also ends.

14. Dispute Resolution

a. Amicable Resolution
Before initiating any formal legal proceedings or arbitration, you agree to first contact Tantransha LLP in writing regarding any dispute or claim arising from these Terms.

b. Arbitration
If the dispute remains unresolved after the amicable resolution period, any controversy or claim shall be resolved through binding arbitration in accordance with Indian law. The venue for arbitration will be Ghaziabad.

15. Governing Law

These terms are governed by the laws of India. Any legal disputes will fall under the jurisdiction of courts in Ghaziabad.

16. Updates and Modifications

Tantransha LLP reserves the right to update these Terms and Conditions, including the EULA, at any time. Users will be notified of material changes via email or in-app notifications.
